THE NEGOTIABILITY OF DRUG TESTING IN THE FEDERAL SECTOR: A POLITICAL PERSPECTIVE

Abstract

The federal government has established one of the nation s most comprehensive random employee drug-testing programs. The federal Labor Relations Authority has several cases pending on the negotiability of such programs. Legally, the issue seems to turn on the regulatory status of E. O. 12564 and implementing guidance issued by the Office of Personnel Management and the Department of Health and Human Services. The thesis of this article, however, is that, given the inherently political context of federal-sector labor relations, a broader analytical perspective is needed. This implies, however, no endorsement or disapproval of the substantive nature of the disputed union bargaining proposals.
