Abstract

This article examines why impasses are important to Pennsylvania's public employees and employers. For public employees, the use and exhaustion of statutory impasse procedures determines the occurrence and legality of any permissible strike. Impasse exists for public employers as the primary exception to the rule prohibiting unilateral change of employment terms and conditions. This analysis should assist public employees and employers in recognizing when impasse exists and what recourses are available to break the impasse.
