Abstract

This paper develops the rationale for the utilization of a special Board of Inquiry in complex labor-management disputes, when collective bargaining breaks down. Drawing upon the experience of the 1973 New York City Cemetery strike the author contends that lengthy and emotionally charged strikes which become impossible to resolve through normal dispute resolution techniques require a new from of neutral intervention. The Special Board of Inquiry is recommended as an alternative settlement tool because of its unique relationship to the political process and its ability to recommend such innovative solutions as one time binding arbitration, a prescribed cooling off period of changes in the statutory impasse resolution procedures.
