Abstract

Same-sex sexual harassment claims have increased dramatically in recent years. Until 1998, the issue of whether such claims were actionable under Title VII of the Civil Rights Act divided federal circuit courts. In 1998, however, the Supreme Court, in Oncale v. Sundowner Offshore Services, Title VII vests cognizable interests in such claims. This comment recites the legislative and judicial history of sex discrimination before focusing on same-sex sexual harassment and the practical implications of Oncale.
