Abstract

Should there be federal legislation that regulates labor relations between state and local governments and their employees? Does such legislation abridge states' rights? This paper is based in part upon a presentation made at the 1974 annual meeting of the National Organization for Legal Problems in Education (NOLPE). It questions whether the Federal government has a constitutional right to control the relationship of state and local governments with their employees, and whether such an administration at the federal level is realistic and feasible even if it is not constitutionally barred.
